Participant Waiver, Release of Liability & Assumption of Risk Agreement

  1. Acknowledgement of Risk

I understand that participation in a Moosey Adventures tour involves travel and recreational activities that carry inherent risks, including but not limited to:

  • Transportation by passenger vehicle
  • Entering and exiting vehicles
  • Walking on sidewalks, trails, stairs, parking lots, and public spaces
  • Exposure to changing weather conditions
  • Uneven terrain
  • Slips, trips, and falls
  • Encounters with wildlife, insects, or natural hazards
  • Participation in activities offered by third-party businesses
  • Actions of other guests, motorists, or members of the public

I understand that injuries, illness, property damage, disability, or death may occur despite reasonable precautions.

  1. Voluntary Participation

I voluntarily choose to participate in this tour and accept all associated risks, whether known or unknown.

I confirm that I am physically capable of participating in the tour activities and will immediately notify the guide if I experience any medical issue, injury, or concern during the experience.

  1. Medical Authorization

In the event of an emergency, I authorize Moosey Adventures and its representatives to seek medical treatment on my behalf.

I understand that I am solely responsible for any medical expenses incurred.

  1. Release of Liability

To the fullest extent permitted by law, I release and discharge Moosey Adventures, its owners, employees, contractors, guides, volunteers, affiliates, and partners from any and all claims, demands, damages, losses, liabilities, actions, costs, or expenses arising from my participation in the tour, except where caused by gross negligence or willful misconduct.

  1. Third-Party Providers

I understand that Moosey Adventures may visit attractions, wineries, restaurants, cafes, parks, shops, and other locations operated by third parties.

Moosey Adventures is not responsible for the actions, omissions, products, services, or facilities provided by these third parties.

  1. Transportation Safety

I agree to:

  • Follow all instructions provided by the driver or guide.
  • Remain seated when requested.
  • Wear a seatbelt whenever available and required.
  • Enter and exit the vehicle safely.
  • Refrain from any behavior that could distract the driver or endanger others.

Moosey Adventures reserves the right to remove any participant whose conduct is unsafe, disruptive, abusive, intoxicated, or negatively impacts the experience of others.

No refund will be provided in such circumstances.

  1. Personal Property

I understand that I am responsible for my personal belongings.

Moosey Adventures is not responsible for lost, stolen, or damaged personal property.

  1. Alcohol Consumption

Participants who choose to consume alcohol during winery visits, tastings, meals, or other stops do so at their own risk.

Moosey Adventures reserves the right to refuse transportation or participation to any guest whose level of intoxication creates a safety concern.

  1. Photography & Media Release

During the tour, photographs and videos may be taken for marketing, social media, website, and promotional purposes.

By signing this agreement, I grant Moosey Adventures permission to use photographs, videos, and recordings containing my likeness without compensation.

  1. Cancellation & Refund Policy

I acknowledge that I have reviewed and agree to Moosey Adventures’ cancellation and refund policy as published on its website or booking platform.

  1. Governing Law

This agreement shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein.
